The new European Regulation for the Protection of Personal Data (GDPR ” General Data Protection Regulation “), which will come into force officially from 25 May 2018, provides for the Right to Cancellation of Personal Data. This is what is called the right to be forgotten and is regulated by Article 17: The interested party has the right to obtain from the data controller the deletion of personal data concerning him without unjustified delay and the data controller is obliged to cancel personal data without unjustified delay, if one of the following reasons exists: personal data are no longer necessary with respect to the purposes for which they were collected or otherwise processed; the interested party revokes the consent on which the treatment is based and if there is no other legal basis for the treatment; the data subject opposes the processing and there is no legitimate prevailing reason to proceed with the processing; personal data have been processed illegally; personal data must be deleted in order to fulfill a legal obligation under the law of the Union or of the Member State to which the data controller is subject; personal data has been collected regarding the offer of information society services.
